Requires Makeup Time for Unfounded Abuse Claims
Illinois · HB5829 · Introduced Oct 28, 2026
Why it matters
A parent who lost court-ordered time over an abuse claim that was later dropped would get that time back. Courts would have to act within six months.
What it does
- Requires courts to order makeup parenting time for a parent denied time over an unfounded abuse or neglect claim
- Makeup time must equal the parenting time that was denied
- Makeup time must be awarded within 6 months after the state finds the report unfounded
- Courts may still hold a parent in contempt for wrongful denial of parenting time

COMPENSATORY PARENTING TIME
Perspectives
💬 The case for
Parents' rights groups would likely say wrongly accused parents should not lose time with their children. They may argue the makeup time corrects an unfair loss.
💬 The case against
Child protection advocates would likely say the bill could discourage reporting of real abuse. They may also worry about added pressure on investigators.
