Requires Readmission to State Developmental Centers
Illinois · HB5824 · Introduced Oct 15, 2026
Why it matters
People with developmental disabilities who need more medical care than their current home can provide could return to a state center. The bill takes effect right away once signed into law.
What it does
- Requires state-run developmental centers to readmit former residents who request it
- Covers former residents now living in licensed community-integrated living arrangements
- Applies if the resident consents, or a guardian with placement authority consents
- Guardian consent requires finding that the resident's medical needs cannot be met where they live now
- If a center cannot readmit someone due to closure or fewer beds, they may choose another state center, if beds are open

About this bill
Would require state developmental centers to readmit former residents on request if they consent, or their guardian consents, and medical needs are not met elsewhere. Would take effect immediately.
Perspectives
💬 The case for
Disability advocates would likely say people who need more medical care should be able to return to a state center. Families would likely say it gives guardians a clear path to get needed care.
💬 The case against
Community living providers would likely say the bill could move residents out of homes they have settled into. State budget watchers may also worry about extra costs for state centers with limited beds.
